The Board, at its meeting on 24 June 2019 amended Education Development Charges By-law 01-2019.  The Board’s by-law was amended pursuant to O. Reg. 55/19, which was enacted by the Province of Ontario on 29 March 2019 and allows for annual increases in EDC rates for qualified school boards.

Any person or organization may appeal the By-law to the Local Planning Appeal Tribunal (LPAT) under Section 257.65 of the Act, by filing with the Secretary of the Board on or before the 5th day of August, a notice of appeal setting out the objection of the By-law and the reasons supporting the objection, along with the required fee payable to the Ministry of Finance.

The schedule of Education Development Charges to be imposed in respect of designated categories residential and non-residential development, and has been calculated in accordance with the rate ‘cap’ imposed under the legislation, is as follows:

On 29 March 2019 the OCDSB received a memorandum from the Ministry of Education (2019: B11, Interim Changes to Education Development Charges) regarding amendments made to Ontario Regulation 20/98, Education Development Charges, which governs the implementation of EDCs within the province.

These amendments were made subsequent to the Board’s adoption of Education Development Charges By-law No. 01-2019 on March 26, 2019 (implemented on April 1, 2019).

The amendments serve to remove a temporary freeze on EDC rates which was put in place in October 2018.  Boards are now restricted to the consideration of rate increases of

i) a maximum yearly increase of the greater of 5% or $300 per residential unit; and

ii) a maximum yearly increase of 5% for non-residential rates.

These changes to the legislation permit the Board to amend By-law No. 01-2019 in order to consider adopting charges which were calculated within the completed December 2018 EDC Background Study.

A Notice of a proposed amendment was published in the Ottawa Citizen on 23 April 2019.

Staff will bring forward Report No 19-067 Adoption of Education Development Charges (EDC) Amending by-law which will be considered at the 18 June 2019 Committee of the Whole meeting (6:45 pm) and the 24 June 2019 Board meeting (7:30 pm).

Please note that members of the public who would like to address the Board at a public meeting may do so as a delegation or through the public question period. 

To appear as a delegation, you must submit a written statement on your issue by 4:00 pm on the Thursday prior to a regularly scheduled Board meeting.  Your written statement will be included in the agenda package.  At the beginning of each Board meeting, a maximum of 20 minutes will be allotted for delegations, with each delegation restricted to two minutes speaking time.  As well, 15 minutes is allotted for questions from the public.  You must register your name in advance of the meeting if you wish to ask a question.

If approved, amended EDC rates would take effect on 29 June 2019.

It should also be noted that the Ministry of Education has indicated that it will be conducting a comprehensive review of the EDC framework.  We will update this site should additional information be provided in the future.



Notice of the Passing of a New Education Development Charges By-law by the OCDSB

The Board, at its meeting on March 26, 2019, adopted motions which serve to implement a new EDC By-law (No. 01-2019) for the OCDSB on April 1, 2019. The education development charges imposed by the By-law are as follows: $723 per dwelling unit, and $0.52 per square foot of gross floor area of non-residential development.

The 
Education Act provides a school board with the ability to implement an Education Development Charges By-law if there is residential development in the area of jurisdiction of the board that would increase education land costs.  As per the legislation, education development charges (EDCs) may be levied against land undergoing residential and/or non-residential development.

The primary purpose in implementing an EDC By-law is to provide a board with a source of funding for growth-related education land costs, i.e. costs to acquire and prepare school sites to accommodate students generated from new development.  The province’s “Student Focused Funding Model” does not include a separate per pupil grant to fund the purchase of new school sites.

The Ottawa-Carleton District School Board has an existing EDC By-law in place.  This by-law came into force on April 1, 2014.  In accordance with provincial regulations, the current by-law is scheduled to expire on March 31, 2019.  In order to continue to fund the purchase of land required for growth-related new school sites through the collection of EDCs, the Board must implement a new by-law on or before this expiry date.

Accordingly, the Board entered into a study and consultative process which examined the possibility of passing a new EDC By-law in 2019.

As part of this process, two special public meetings were held on January 15, 2019 prior to the regularly scheduled meeting of Committee of the Whole.  These meetings were convened in order to review the policies contained within the Board’s existing EDC By-law and those which will help form the proposed new by-law in 2019.

The first public meeting was convened to review the policies contained in the Board’s existing Education Development Charges By-law No. 02-2014.

The second public meeting was convened to receive input and hear delegations regarding a proposed new by-law and the EDC Background Study prepared in support of its consideration.

The EDC Background Study was presented at the meeting.  It was available to members of the public via our website on December 18.  After this date, hardcopies of the study were made available at the main reception (133 Greenbank Road) upon request.

Please note that pursuant to O. Reg., 438/18 imposed on October 12, 2018, a school board may not adopt EDCs that are higher than the current in-force by-law rates. One of the purposes of the meeting will be to convey what the EDC rates would have been had this Regulation not been adopted by the province. 

Subsequent to receiving input from Trustees, stakeholders, and the public regarding the proposed new by-law, staff brought a recommendation report forward for consideration to the February 19, 2019 meeting of Committee of the Whole.  

Report 19-021 Adoption of Education Development Charges By-law (2019-2024) and the assumed approved recommendations contained therein were scheduled to be considered by Board at its meeting held on February 26, 2019.  At that meeting, Trustees made the decision to defer the report and recommendations to the March 26, 2019 Board Meeting. 

If approved by Board, the new By-law would be implemented effective April 1, 2019.
